Legal and Regulatory Constraints
Handling Of Stories Involving Minors- the role of this rule is to protect under 18s are protected. This is done by concerning or not allowing materiel that might mentally or physical impair an under 18 by not allowing it to be broadcast. This is imposed by using a watershed, this means shows or films that contain graphic or indecent content can only be shown between 21:00-5:30 and in terms of radio they must schedule there materiel to best be shown when there are less likely to be children listening.
Contempt Of Court- contempt of court is disobedience or misconduct or disregard if a court order in the presence of court, or action that will interfere with the judges ability to administer justice in court.examples of contempt of court are shouting out in court, making false representation in court, refusal to recognize the court or recording the court either visual or audio.
Libel And Defamation- defamation is when a statement or news article or news story makes people think the worst of someone without any evidence or been found guilty including, criminality lack of integrity or personal morality. Libel is another form of defamation and is writing or recording something that is either false or damaging about someone.
Coverage Of Elections- Ofcom guidelines state that broadcasters whether radio or television aren't allowed to be bias when it comes to elections, this involves publishing shows that could hard either of the party around election time.
Official Secrets Act- The official secrets act makes it illegal to share information in regards to
defense, security and intelligence, international relations, intelligence gained from other departments or international organizations, intelligence useful to criminals, or the interception of communications.
The following story relates to the guardian newspaper being asked to disclose there confidential sources in regards to the phone hacking scandal by Scotland yard under the official secrets act claiming it was a breach of the official secret act. Scotland yard tried to use the official secrets act to gain information on the person who gave them information on the phone hacking. In my opinion the newspaper do not have to give the information away as it is not in the interest of national security although the official secret act could be more clearer in regards to the media.
